FGCU Name, Image, Likeness

  • Student-athletes may earn compensation for their name, image, and likeness.  Such compensation must be within fair market value.
  • Florida Gulf Coast University, the athletic department, and staff members may not compensate a current or prospective intercollegiate athlete for her or his name, image, likeness
  • Compensation may not be provided in exchange for athletic performance, participation or attendance at the Florida Gulf Coast University.
  • The expectation is that NIL compensation opportunities will not conflict with academic or team related activities.
  • Student-athletes will only be allowed to use University or athletic department related marks and logos, including all aspects of the uniform, if those rights have been secured through an agreement granting specified rights. You can request sponsorship information and/or an agreement by contacting FGCU Athletics Marketing, Corporate Sponsorships, and University Marketing.
  • The use of athletic department facilities will require approval in advance (location agreements, including waiver of liability forms and applicable rental fees). Rental and waiver of liability agreements will be coordinated with the Facility and Operations Department.
  • An institution may provide assistance and services to a student-athlete who elects to disclose name, image and likeness activities consistent with institutional policies and procedures. A student-athlete who elects not to disclose name, image and likeness activities shall not receive such institutional assistance and services.
    • A student-athlete who elects to disclose name, image and likeness activities must provide such disclosures not later than 30 days after entering into or signing an agreement. Upon initial enrollment at the certifying institution, a student-athlete who elects to disclose name, image and likeness activities must provide the institution all current and expired name, image and likeness activities not later than 30 days after enrollment.
    • Disclosure at FGCU can be initiated through the Name, Image and Likeness Approval workflow in ARMS.
  • Student-athletes may secure representation (agent or lawyer), ONLY for Name, Image and Likeness and NOT for future professional athletic contract negotiations.
    • An individual may use professional services, including agent representation, for the purpose of name, image and likeness activities. Business arrangements related to representation for purposes of name, image and likeness activities (e.g., travel expenses associated with meeting) shall be consistent with arrangements between the professional service provider and other prospective or current clients and align with industry standards.
  • An athlete agent representing a student-athlete for purposes of securing compensation for her or his name, image, likeness, or persona must be licensed in the state of Florida.
  • An attorney representing a student-athlete for purposes of securing compensation for her or his name, image, likeness, or persona must be a member in good standing of The Florida Bar.
  • A student-athlete under the age of 18 years must have any contract for compensation for her or his name, image, likeness, or persona approved under state statutes 743.08 and 743.09.
  • International student-athletes should not enter into any NIL agreements without the guidance from the Florida Gulf Coast University International Services Center to guard against any potential immigration issues.
  • The FGCU Athletics Student-Athlete Development staff will provide student athletes with financial literacy workshops.
  • The FGCU Athletics Communications Office will assist with brand building and educational workshops focusing on the areas of Name, Image and Likeness.
  • Pell Grant or need based financial aid could be impacted based on compensation from Name, Image and Likeness. Those questions should be directed to Florida Gulf Coast University Financial Aid Office.
  • It is not permissible for Florida Gulf Coast to provide financial, physical or human resources or any other form of indirect financial support to an NIL entity (e.g., collective).
